29 CFR 1926.62(d)(2)(i): Until the employer performed an employee exposure assessment, as required in 29 CFR 1926.62(d), and documented that the employee(s) performing any of the listed tasks was not exposed above the Permissible Exposure Limit (PEL), the employer did not treat affected employee(s) as if they were exposed above the PEL, and not in excess of ten times the PEL, and did not implement employee protective measures prescribed in 29 CFR 1926.62(d)(2)(v): 846 E Pleasant Street Amherst, MA: On or about November 24, 2015, two employees removed ten windows which contained lead paint and the employer had not performed an employee exposure assessment, had not treated the affected employees as if they were exposed above the PEL and had not implemented employee protective measures including providing appropriate respiratory protection, appropriate protective clothing and equipment, change areas, hand washing facilities, biological monitoring or training.

The employer did not include lead in the program established to comply with the Hazard Communication Standard (HCS) (� 1910.1200) and did not provide employees with information on the reproductive/development toxicity, central nervous system effects, kidney, blood and acute toxicity effects of lead. 846 E Pleasant Street Amherst, MA: On or about November 24, 2015, the employer did not include lead in the hazard communication program and did not provide employees with information on the health hazards associated with lead to employees who removed residential windows which contained lead paint.
