29 CFR 1910.212(a)(1): Types of guarding. One or more methods of machine guarding shall be provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks. Examples of guarding methods are-barrier guards, two-hand tripping devices,electronic safety devices, etc. a. At the central warehouse main chain back line, employees worked on and around a conveyor restacking boxes while the conveyor was in operation, thereby exposing the employees to a caught-in hazard.

29 CFR 1910.23(c)(1): Every open-sided floor or platform 4 feet or more above adjacent floor or ground level shall be guarded by a standard railing (or the equivalent as specified in paragraph (e)(3) of this section) on all open sides except where there is entrance to a ramp, stairway, or fixed ladder. The railing shall be provided with a toeboard wherever, beneath the open sides a. At the central warehouse main chain back line where employees accessed a elevated platform to restack boxes, there was no railing to protect employees from a 4 foot 11.25 inch fall hazard. J.C. Penney was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1910.23(c)(1), which was contained in OSHA inspection number675118, citation number 1, item number 2 and was affirmed as a final order on October 30, 2012, with respect to a workplace located at 2202 Bellview Road, Rogers, Arkansas 72758.
