OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck-by hazard:    (a)  Dinklage Feed Yard Inc, at 13946 Morgan County Road 21, Fort Morgan, CO:  On and preceding 11/26/15, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to a struck-by hazard.  A John Deere model 524K front end loader operated in the mill yard, transporting ground hay, silage, and hot milled corn from piles to mixers.  The mill yard was open to entry by employees from the area where the feed trucks were parked to receive a load of feed.  Dust from the ground hay and steam from the milled corn were generated, reducing visibility.  On 11/26/15 a feed truck operator entered the mill yard while the front end loader was operating.  This condition exposed the employee to a struck-by hazard.    Abatement Note: Among other methods, feasible abatement methods include:  1. Erection of barricades or installation of other engineering controls to prevent workers from entering the mill yard while heavy equipment, such as a front end loader, is operating.  2. Ensure workers are wearing high visibility clothing, for example traffic vests, where potential for struck-by hazard exists.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to physical hazards such as shock and bleeding when they did not have ready access to emergency medical care:    (a)  Dinklage Feed Yard Inc, at 13946 Morgan County Road 21, Fort Morgan, CO:  On and preceding 11/26/15, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees did not have ready access to emergency medical care.  Employees performed work operations related to the care and feeding of cattle at a feed lot, including but not limited to operation of and working around heavy machinery, conveyors, and other equipment, entry into permit required confined spaces, and interactions with beef cattle.  The feed lot was located approximately six miles from the volunteer fire department.  The response time for EMS following an accident on 11/26/15 was approximately twenty two minutes.  Employees were not trained in first aid or CPR.  Employees did not have ready access to emergency medical care.    Abatement Note: Among other methods, feasible abetment methods include:  1. Train employees with regards to first aid and cardiopulmonary resuscitation (CPR).    Note: the American Red Cross supports the position that improved training and access to an automated external defibrillator (AED) could save lives.

OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to confined space hazards including entanglement, combustible dust, engulfment, and atmospheric hazards:  (a)  Dinklage Feed Yard Inc, at 13946 Morgan County Road 21, Fort Morgan, CO:  On and preceding 12/22/15, the employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees, in that employees were exposed to confined spaces hazards.  Employees entered the corn bin to perform end of season cleaning of residual corn.  The employees entered the small leg boot pit and big leg boot pit to clean the pits.  The employees entered the truck scale pit to clean the pit.  The corn bin, well #2 pit, small leg boot pit, big leg boot pit, and truck scale were determined by the employer to be confined spaces and to contain multiple hazards, including entanglement hazards, combustible dust hazards, engulfment hazards, and atmospheric hazards.  The employer had not addressed emergency procedures, provided emergency retrieval equipment, and provided adequate entry training.  This condition exposed employees to confined space hazards.

29 CFR 1910.1200(g)(8):  The employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work area(s):    (a)  Dinklage Feed Yard Inc, at 13946 Morgan County Road 21, Fort Morgan, CO:  On and preceding 1/22/16, the employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work areas.  Employees performed duties related to the care and feeding of cattle.  The employer did not maintain in the workplace copies of the safety data sheets for each hazardous chemical in their work area, including but not limited to the following:    1.  APTechgroup Inc BC4A (containing 5-15% sodium hydroxide); and  2.  APTechgroup Inc OLC-C (containing 0.5% acrylic acid-polycarboxylate).    (b)  Dinklage Feed Yard Inc, at 13946 Morgan County Road 21, Fort Morgan, CO:  On and preceding 1/22/16, the employer did not maintain in the workplace copies of the required safety data sheets for each hazardous chemical, and did not ensure that they were readily accessible during each work  shift to employees when they were in their work areas.  Employees performed duties related to the care and feeding of cattle.  The employer kept safety data sheets in the main office.  Employees used chemicals in work areas, such as the mill, which were located several hundred yards across the feed yard from the office.  The employer did not ensure that the safety data sheets were readily accessible to employees in their work areas.  This condition exposed employees to a chemical hazard.
