On or about November 25, 2015, at the above addressed jobsite, employees were operating a powered industrial vehicle (Caterpillar TL1055D, Caterpillar TL1255C) during steel erection operations. Synthetic web slings used to hoist material did not mark the name or trademark of manufacturer, rated capacity, or the type of material, thereby exposing employees to struck by hazards.

Synthetic web slings shall be immediately removed from service if any of the following conditions are present:  (i) Acid or caustic burns  (ii) Melting or charring of any park of the sling surface  (iii) Snags, punctures, tears or cuts  (iv) Broken or worn stitches  (v) Distortion of fittings    a. On or about November 25, 2015, at the above addressed jobsite, employees were performing steel erection operations with rigging which included, but not limited to synthetic web slings. Synthetic web slings used to hoist material had evidence of snags, punctures, tears, cuts, and broken/worn stiches which were not immediately removed from service, thereby exposing employees to struck by hazards.

29 CFR 1926.752(b): Commencement of steel erection. A steel erection contractor shall not erect steel unless it has received written notification that the concrete in the footings, piers and walls or the mortar in the masonry piers and walls has attained, on the basis of an appropriate ASTM standard test method of field-cured samples, either 75 percent of the intended minimum compressive design strength or sufficient strength to support the loads imposed during steel erection:  a. On or about November 25, 2015, at the above addressed jobsite, prior to performing steel erection operations the employer did not receive written notification that the concrete in the footing, piers and walls attained 75 percent of the intended minimum compressive design strength or sufficient strength to support the loads during steel erection activities, thereby exposing employees to struck by and/or crushing hazards.
