29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, face, head, and extremities, protective clothing, respiratory devices, and protective shields and barriers, were not provided, used, and maintained in a sanitary and reliable condition wherever necessary by reason of hazards of processes or environment:      a)  Fall protection harness with positioning device (short lanyard) were not provided to employees who were installing reinforcement steel during construction of a 12 ft tall foundation wall; without positioning device the employees had to keep from falling while standing on single plank platforms.     Location: 1040 Dean Street, Brooklyn, N.Y.    On or about  10/20/2015    NOTE: THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT CERTIFICATION FOR THIS ITEM IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.501(b)(5):  Each employee on the face of formwork or reinforcing steel was not protected from falling 6 ft (1.8m) or more to lower levels by personal fall arrest systems, safety net systems, or positioning device systems:     a)  Employees were exposed to fall hazard when installing reinforcement steel during construction of a 12 ft tall foundation wall; the employer did not provide fall protection harnesses and positioning device(s).
