29 CFR 1926.602(d): The employer did not certify that each operator had been trained and evaluated as required by paragraph 29 CFR 1910.178(l). a) 8 and 14 Twister Way, Freeville, NY 13068, On or about 11/25/15: Operators of Terex telescoping material handler were not trained and certified in its operation and use. The requirements applicable to construction work under this paragraph are identical to those set forth at 1910.178(l) of this chapter. 29 CFR 1910.178(l)(1)(ii) Prior to permitting an employee to operate a powered industrial truck (except for training purposes), the employer shall ensure that each operator has successfully completed the training required by this paragraph (l), except as permitted by paragraph (l)(5).
