There were no frequent and regular inspections of the job sites made by a competent person that was knowledgeable of the regulations and requirements to ensure the job site and equipment such as but not limited to the Vanco insulation machine were in a safe condition.

29 CFR 1926.21(b)(2): The employer shall instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury. Employees were not instructed in the recognition and avoidance of unsafe conditions and the regulations applicable to the job sites requiring the use of the Vanco insulation machine to control or eliminate the hazards that may exist or be created.

29 CFR 1926.307(f)(3): "Sprockets and chains." All sprocket wheels and chains shall be enclosed unless they are more than 7 feet (2.128 m) above the floor or platform. Where the drive extends over other machine or working areas, protection against falling shall be provided. This subparagraph does not apply to manually operated sprockets. Employees were exposed to caught in between hazards while using the Vanco insulation machine where the sprocket wheels and chains were not enclosed.

29 CFR 1910.134(c)(2)(i): An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"); and On December 4, 2015, employees were provided and wore 3M 8210 N95 respirators for voluntary use and the employer did not provide the users with the information included in Appendix D.
