29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):    At the above addressed jobsite, an employee was required to operate a Gehl RS8-42 telescopic rough terrain forklift and had not received adequate training and evaluation on the safe operation of this powered industrial truck prior to being assigned to operate the truck. The powered industrial vehicle was used to hoist, transport and set wall panels and pre-fabricated trusses using synthetic web straps as rigged to the forks of the powered industrial vehicle, thereby exposing employees to struck-by and crushing hazards.    Abatement documentation is required for this item in accordance with the requirements of 29 CFR 1903.19(d).

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:    At the above addressed jobsite, employees engaged in commercial framing operations, between nine (9) feet and ten (10) feet above the ground, were not protected from falling, thereby exposing employees to fall hazards.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).

29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval:    At the above addressed jobsite, employees lifted pre-fabricated wall panels and pre-fabricated trusses using synthetic fiber webbing placed around the forks of a Gehl RS8-42 rough terrain forklift when this practice is not recommended and/or approved by the manufacturer. The employees were thereby exposed to struck by and/or fall hazards due to failure of lifting components.    Abatement certification is required for this item in accordance with the requirements of 29 CFR 1903.19(c).
