OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm in that employees were exposed to a struck-by hazard: On or about November 23, 2015, at the construction site on FM 306, Spring Branch, TX, the employer failed to ensure the employees were protected from being struck by vehicular traffic. The employees and equipment were continuously crossing over an active two lane road with no traffic control procedures, a flagger with no stop or slow paddles, no warning signs indicating traffic may stop and the flagger was not position in a safe place. Employees were exposed to the hazard of getting struck-by vehicular traffic.

29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his/her environment to control or eliminate any hazards or other exposure to illness or injury: On or about November 23, 2015, at the construction site on FM 306, Spring Branch, TX, the employer failed to ensure the employee that was performing the job task of flagging was trained and instructed on such items as, but no limited to, traffic control plan, what paddles to use and a safe position to stand. The employee was exposed to a struck-by hazard from vehicular traffic.
