OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and fall hazards from an inadequately maintained aerial lift:      Jobsite:   On or about December 2, 2015, and at times prior thereto, employees were exposed to struck-by and fall hazards while working on and around a Genie S-85 aerial lift that was not maintained in accordance with the manufacturer's instructions.  Quarterly maintenance was not performed on the aerial lift; troubleshooting was not done by a qualified person, and the lift was not removed from service or repaired after it malfunctioned.  An employee operating the lift was fatally injured when he was thrown from the lift's work platform.
