29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed:  a) At the jobsite:  A 32-foot portable extension ladder was used for access to a residential roof approximately 24 feet high and the ladder side rails did not extend at least 36 inches, observed on or about December 3, 2015. 29 CFR 1926.150(c)(1)(vi): A fire extinguisher, rated not less than 10B, was not provided within 50 feet of wherever more than 5 gallons of flammable or combustible liquids or 5 pounds of flammable gas were being used on the jobsite:  a) At the jobsite: Employees were using 10 gallons of flammable liquid (Low-VOC Bonding Adhesive) for single-ply roofing and a fire extinguisher was not provided within 50 feet, observed on or about December 3, 2015. 29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a) Jobsite, 313 N. River Rd, Wilkes-Barre, PA:  Employees were performing residential roof repair and replacement activities approximately twenty-four (24) feet above the ground level without fall protection, observed on or about December 3, 2015.  Abatement certification and documentation is required within 10 days of abatement date. The certification shall include as statement that abatement is complete, the date and method of abatement, and state that employees and their representatives were informed of this abatement. Abatement documentation shall include documents demonstrating that abatement is complete, such as evidence of the purchase or repair of equipment, photographic or video evidence of abatement or other written records.

29 CFR 1926.1053(b)(22): Employees using ladders were carrying objects or loads that could cause the employee to lose balance and fall:   a) At the jobsite:  Employees were carrying roofing tools and equipment, roofing materials, and five-gallon containers of bonding adhesive while using the ladder to access the roof, observed on or about December 3, 2015.                        Alberto Rodriguez dba J.A.C. Construction aka Jac Roofing Contractors was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.1053(b)(22), which was contained in OSHA inspection number 978875, citation number 1, item number 5, and was affirmed as a final order on December 16, 2014, with respect to a workplace located at 71 Wintergreen Avenue West, Building 16, Edison, NJ 08820.

ABATEMENT CERTIFICATION IS REQUIRED FOR THIS VIOLATION.
