OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to thermal burns: Site, 57 West Dedham Street, Boston: On or about November 23, 2015, an employee who was working on top of the fryers removing filters and cleaning the exhaust vent hood duct suffered thermal burns to the feet, ankles and leg when the platform shifted and he fell into the hot frying oil.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: Site: Employer had not developed and implemented a written Hazard Communication Program for employees who were exposed to hazardous materials such as cleaning products that contain sodium and/or potassium hydroxide. The Hazard Communication Program includes labeling requirements, list of hazardous chemicals, employee training and methods used to inform other employers of precautionary measures to be taken.
