OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crush hazards while operating a Lull without a working seatbelt:  a)  At 314 East 1st Ave Gulf Shores, Alabama:  On or about December 1, 2015 and at times prior; the employer exposed his employees to crush hazards in that employees were allowed to operate a Lull without wearing a seatbelt.

29 CFR 1910.178(l)(1)(i): The employer did not ensure that each powered industrial truck operator is competent to operate a powered industrial truck safely, as demonstrated by the successful completion of the training and evaluation specified in this paragraph (l):  a)  At Bravo Company, LLC Gulf Shores, Alabama:  On or about December 1, 2015 and at times prior; the employer exposed his employees to struck-by hazards in that employees are allowed to operate a powered industrial truck without the employer first ensuring the employee was competent to operate the equipment as demonstrated by the completion of the required training and evaluation specified in the regulation.

29 CFR 1926.501(b)(13): Each employee(s) engaged in residential construction activities 6 feet (1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system, nor were employee(s) provided with an alternative fall protection measure under another provision of paragraph 1926.501 (b):   a)  At 314 Eat 1st Ave Gulf Shores, Alabama:  On or about December 1, 2015 and at times prior; the employer allowed his employees to work from a high slope roof without fall protection exposing them to a fall hazard of 35 feet to ground below.   THE BRAVO COMPANY, LLC WAS PREVIOUSLY CITED FOR A VIOLATION OF THIS OCCUPATIONAL SAFETY AND HEALTH STANDARD OR ITS EQUIVALENT STANDARD 29 CFR 1926.501(B)(13), WHICH WAS CONTAINED IN OSHA INSPECTION NUMBER 957494, CITATION NUMBER 1, ITEM NUMBER 1 AND WAS AFFIRMED AS A FINAL ORDER ON FEBRUARY 28, 2014, WITH RESPECT TO A WORKPLACE LOCATED AT 4860 STATE HIGHWAY 180, GULF SHORES, ALABAMA.
