OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by and crushed-by hazards:  a) Cemetery ; On or about December 3, 2015 and at times prior the employer failed to ensure equipment was maintained per the manufactures guidelines and allowed employees to use a Case skid steer that had damaged safety equipment (Missing seatbelt, battery cover, safety bar and interlock).  a)  Cemetery ; On or about December 3, 2015 and at times prior the employer failed to ensure equipment was maintained per the manufactures guidelines and allowed employees to not use a John Deere backhoe that had a damaged outrigger and was missing bushings on the upper portion of the boom.

29 CFR 1910.305(d)(2): Panelboards were not mounted in cabinets, cutout boxes, or enclosures approved for the purpose and were not dead front  a)    Electrical panel in the maintenance shop: On or about December 3, 2015 the employer exposed employees to electrocution hazards in that  employees were allowed to walk and work around a 120 volt panel that did not have a dead front cover.

29 CFR 1910.22(a)(1): All places of employment, passageways, storerooms or service rooms were not kept clean and orderly or in a sanitary condition.  a) Facility; On or about December 3, 2015 and at times prior thereto the employer exposed employees to slip and trip hazards in that employees were required to walk and work in areas that had large quantities of material, tools and equipment blocking the work spaces and walkways in the facility.
