On or about December 3, 2015 during excavation activities, the employer did not ensure means of egress out of the excavation was not greater than 25 ft of lateral travel for employees. The only ladder to exit the excavation was placed a distance of ~28ft 6in away from employee working in the furthest working location.

29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with paragraph (b) or (c) of this section:    a) Jobsite, near 1122 Sheffield Street, Pittsburgh, PA: On or about December 3, 2015, during excavation activities, the employer did not ensure that an adequate cave in protective system was in place, in that there was no cave in protection inside the trench that was measured to be 6ft 7in in depth where employees were working.    Independent Enterprises, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 1926.652(a)(1), which was contained in OSHA inspection number 958963, citation number 1 , item number 2, group a, and was affirmed as a final order on May 5, 2014, with respect to a workplace located at 520 Aspen Street, Pittsburgh, PA.
