29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards:  Note:  Toeboards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard.  On or about December 3, 2015, a worker was observed on the platform at the top of the milk delivery tank trailers that was not properly guarded with a toeboard or other equivalent means as required.  There is approximately 18 inches between the mid-rail of the mobile guardrail system to the sharp sloping side of the trailer, approximately 10.5 feet above the floor below.
