29 CFR 1910.147(c)(1): The employer did not establish a program consisting of an energy control procedure, employee training and periodic inspections to ensure that before any employee performed any servicing or maintenance on a machine or equipment where the unexpected energizing, startup or release of stored energy could occur and cause injury, the machine or equipment shall be isolated from the energy source and rendered inoperative:    a) On or about November 30, 2015, the employer did not establish a program consisting of an energy control procedure, employee training, and periodic inspections to protect employees from unexpected energizing, startup or release of stored energy during maintenance tasks, such as cleaning, placing double sided tape inside of the CNC machines, and setting up CNC machines, including the D9 CNC machine.  In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(c)(4)(i): Procedures were not developed, documented and utilized for the control of potentially hazardous energy when employees were engaged in activities covered by this section:   a) On or about November 30, 2015, the employer failed to ensure an energy control procedure was developed, documented, and utilized for the control of hazardous energy when an employee was engaged in maintenance tasks, such as cleaning, placing double sided tape inside of the CNC machines, and setting up the CNC machines, including the D9 CNC machine.   In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.

29 CFR 1910.147(c)(7)(i): The employer did not provide adequate training to ensure that the purpose and function of the energy control program was understood by employees:   a) On or about November 30, 2015, an employee performed maintenance tasks, including cleaning and placing double sided tape inside of the D9 CNC machine. The employee was not trained to lockout or tagout the CNC machine and was potentially exposed to being struck by moving parts inside the machine.  In accordance with 29CFR 1903.19(d), abatement certification is required for this violation (using CERTIFICATION OF CORRECTIVE ACTION WORKSHEET), and in addition, documentation that abatement is complete must be included with your certification. This documentation may include, but is not limited to, evidence of the purchase or repair of the equipment, photographic or video evidence of abatement or other written records.
