OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    a)     This violation occurred on or about December 03, 2015, in the new single family residential neighborhood, where an employee riding unrestrained on the side of a moving Ram 5500 truck was exposed to a fall hazard.      Among other methods, one feasible and acceptable means to correct the hazard is to ensure that each occupant of a motor vehicle is in a seat and properly restrained in accordance with the owners manual which states: "It is dangerous to ride in a cargo area, inside or outside of a vehicle.  In a collision, people riding in these areas are more likely to be seriously injured or killed.  Do not allow people to ride in any area of your vehicle that is not equipped with seats and seat belts.   Be sure everyone in your vehicle is in a seat using a seat belt properly."
