29 CFR 1910.23(a)(8)(ii): Every floor hole into which persons could accidentally walk were not guarded by a floor hole cover of standard strength and construction:    a)  Front Dock, on or about 12/9/15:  A four inch floor drain was not provided with a cover.    b)  Cardboard Receptacle Area, on or about 12/9/15:  A five inch floor hole along the length of a fixed stairway platform and wall of building was not guarded.    Abatement certification must be submitted for item a.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use:    a)  Packing Room/Tomato Room, on or about 12/9/15:  There was no eye wash provided for employees using Oasis 146 Multi-Quat Sanitizer, a corrosive product.    b)  Shed, on or about 12/9/15:  There was no eye wash provided for employees dispensing Oasis 146 Multi-Quat Sanitizer, a corrosive product, into spray bottles.    Abatement certification must be submitted for these items.

29 CFR 1910.157(g)(2): The educational program to familiarize employees with the general principles of fire extinguisher use and the hazards involved with incipient stage fire fighting was not provided to all employees upon initial employment, and at least annually thereafter    a)  At the establishment, on or about 12/9/15:  Training was not provided to employees on the use of fire extinguishers and the hazards involved with incipient stage fire fighting.    *ABATEMENT NOTE:  By this date the employer must either correct the alleged violation or implement a Fire Safety Policy as outlined in 29 CFR 1910.38 and 29 CFR 1910.39 which includes the evacuation requirements of 29 CFR 1910.157(b).    Abatement certification must be submitted for this item.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met; specifically:        1)  Labeling and other forms of warning;      2)  SDS requirements for the hazardous materials known to be present in the workplace;      3)  Employee training and information.    The written program must also include:            (a)  A list of all the chemicals used in the workplace.          (b)  Methods to inform employees of hazards associated with non-routine tasks.          (c)  Methods the employer will use to inform any contractor's employees of workplace hazards.    a)  At the establishment, on or about 12/9/15:  There was no written hazard communication program or employee training for employees using and/or exposed to various products, including, but not limited to Oasis 146 Multi-Quat sanitizer, Spray Nine multi purpose cleaner, etc.    Abatement certification must be submitted for this item.
