29 CFR 1926.501(b)(14): Each employee working on, at, above, or near wall openings (including those with chutes attached), where the outside bottom edge of the wall opening was 6 feet (1.8 m) or more above lower levels and the inside bottom edge of the wall opening is less than 39 inches (1.0 M) above the walking/working surface, was not protected from falling by the use of a guardrail system, a safety net system, or a personal fall arrest system:    a)    Elevator opening, 2nd floor: Employees without fall protection working in the approximate 5 foot rough opening of an elevator shaft were exposed to an approximate 15 foot fall to concrete, while setting up an extension ladder for use in the installation of the 25 foot long, 2 inch hydraulic oil pipe, on or about 12/07/2015;    b)    Elevator opening, 3rd floor: Employees without fall protection working in the approximate 5 foot rough opening of an elevator shaft were exposed to an approximate 26 foot fall to concrete, while setting up a wood beam from the 3rd floor surface to a bracket at the back of the elevator shaft, on or about 12/07/2015.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.

29 CFR 1926.503(a)(1): The employer did not provide a training program for each employee potentially exposed to fall hazards to enable each employee to recognize the hazards of falling and the procedures to be followed in order to minimize these hazards:    a)    Jobsite 3221 Rte 38 West: Employees had not been trained in the requirements for the use of fall protection when working adjacent to or in the rough openings of elevator shafts during the installation of elevator equipment; employees exposed to approximate 15 foot fall to concrete from rough opening for the 2nd floor elevator doors, on or about 12/07/2015.    NOTE:  IN ADDITION TO ABATEMENT CERTIFICATION, THE EMPLOYER IS REQUIRED TO SUBMIT ABATEMENT DOCUMENTATION FOR THIS ITEM, FAILURE TO COMPLY WILL RESULT IN AN ADDITIONAL PENALTY OF $1000.00 IN ACCORDANCE WITH 29 CFR 1903.19.
