OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees:    On or about December 9, 2015 at the 12010 S Choctaw Drive Baton Rouge, Louisiana location, the employer did not furnish employment and a place of employment which were free from the recognized hazards of falling and or crush by in the event the operator bumps the control and the bucket continues up into the level above, which is likely to cause death or serious physical harm such as broken limbs or trauma, from the front bucket of a Caterpillar 930K wheel loader as it was raised to a height of approximately 6-7 feet, held stationary and then lowered in order to clean deposits of cement mixture from the skirting surrounding the dispenser of the batch house.
