29 CFR 1926.451(g)(1): Employees on scaffolds more than 10 feet (3.1 m) above a lower level were not protected from falling to that lower level by fall protection established in paragraphs (g)(1)(i)-(vii) of this section:  a) On or about December 9, 2015 at 33344 Perdido Beach Blvd, Orange Beach, Al: The employer failed to ensure employees working from a carpenters scaffold installing plywood sheets to the outer wall were protected from falls of 11 feet 4 inches.

29 CFR 1926.451(b)(2)(ii): When walkways between scaffold sections are less than 18 inches wide, employees were not protected from falls by guardrail systems or personal fall arrest systems:  a) On or about December 9, 2015 at 33344 Perdido Beach Blvd, Orange Beach, Al: The employer failed to ensure employee had at least 18 inch width of platforms to work from, only a 2x12 plank was being used, exposing employees to falls up to 11'4".

29 CFR 1926.451(b)(1)(i): Each platform unit (e.g., scaffold plank, fabricated plank, fabricated deck, or fabricated platform) was not installed so that the space between adjacent units and the space between the platform and the uprights were no more than 1 inch (2.5 cm) wide, except where the employer can demonstrate that a wider space is necessary.  a) On or about December 9, 2015; 33344 Perdido Beach Blvd, Orange Beach, Al: Employees working from a scaffold plank which was set up approximately 11 inches from the face of the wall were exposed to falls of 11'4" to the ground.
