29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights), more than six feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around such holes.   a) Delaware Orthodontics/2470 Pulaski Highway -  On or about December 6, 2015, the employer failed to protect their employees from a floor opening for a newly constructed sky light of approximately 15 feet above ground level, an employee was exposed while sweeping off the newly installed flat rubber roof when they fell through the opening and broke multiple bones.

29 CFR 1926.503 (a)(1): The employer did not provide a training program for each employee who might be exposed to fall hazards:  a) Delaware Orthodontics/2470 Pulaski Highway-  On or about December 6, 2015, employees were instructed to install a new roof, approximately 15 feet above ground level without being provided the necessary training on when and how to wear a fall arrest system.  Abatement Note    The training program must enable the employees to recognize the hazards of falling and must train each employee in the procedures to be followed in order to minimize these hazards.  Each employee must be trained by a competent person in the following:    1.  The nature of fall hazards in the work area; 2.  The correct procedures for erecting, maintaining, disassembling, and inspecting the    fall  protection systems to be used; 3. The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used; 4. The role of each employee in the safety monitoring system when this system is used; 5. The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs; 6. The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection;  7. The role of employees in fall protection plans; 8. The standards contained in this subpart.    The employer must verify compliance with paragraph (a) of this section by preparing a written certification record that will contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer.

29 CFR 1904.39(a)(2): The employer did not report an in-patient hospitalization, amputation, or loss of an eye as a result of a work-related incident to OSHA within twenty-four (24) hours.   a) Delaware Orthodontics/ 2470 Pulaski Highway -On or about December 6, 2015, the employer did not report the hospitalization of an employee who fell approximately 15 feet above ground level while sweeping off the newly installed flat rubber roof  breaking multiple bones. This hospitalization was reported by the employer on December 10, 2015, four days after the hospitalization occurred.
