29 CFR 1926.300(b)(1): Power operated tool(s), designed to accommodate guards, were not equipped with such guards when in use.    At the job site, an employee engaged in grinding activities was operating a portable grinder without a guard exposing the employee to struck-by hazards.

29 CFR 1926.300(c): Employees using hand and power tools and exposed to the hazard of falling, flying, abrasive, or splashing objects, or exposed to harmful dusts, fumes, mists, vapors, or gases were not provided with the particular personal protective equipment necessary to protect them from the hazard.  All personal protective equipment did not meet the requirements nor was it maintained according to subparts D and E of this part.    At the job site, an employee operating a portable grinder without eye protection exposed the employee to the hazard of being struck-by the flying debris.

29 CFR 1926.453(b)(2)(v): A body belt was not worn and/or a lanyard was not attached to the boom or basket when working from an aerial lift: Note:  As of January 1, 1998, subpart M of this part (1926.502(d)) provides that body belts are not acceptable as part of a personal fall arrest system:    An employee engaged in grinding activities while working from a bucket of an elevated aerial lift was not protected from a fall hazard by the use of a full body harness and lanyard attached to the bucket.  The employee was exposed to a fall hazard of approximately 28 feet to the concrete below.      Verity Signs was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 1926.453(b)(2)(v), which was contained in OSHA inspection number 770024, citation number 1, item number 2 and was affirmed as a final order on January 10, 2013 with a final abatement date of December 5, 2012 with respect to a workplace located at 601 Shepherd Drive Garland, Texas 75042.
