29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (Construction Reference: 1926.59)  At the residential construction site located at 5300 SW Mission Ave. in Topeka Kansas:  Employees engaged in roofing activities were exposed to chemical hazards in that a written hazard communication program had not been developed and implemented to ensure that employees were aware of the hazards associated with the chemicals with which they work.  Hazardous chemicals used at the site included but were not limited to gasoline.

29 CFR 1910.1200(g)(8): The employer did not maintain copies of the required material safety data sheets for each hazardous chemical in the workplace: (Construction Reference: 1926.59)  At the residential construction site located at 5300 SW Mission Ave. in Topeka Kansas:  Employees engaged in roofing activities were exposed to chemical hazards in that a copy of the required safety data sheet for gasoline was not maintained at the residential construction site exposing employees to dermatitis and burns.

29 CFR 1910.1200(h)(1): Employees were not provided effective information and training on hazardous chemicals in their work area at the time of their initial assignment and whenever a new hazard that the employees had not been previously trained about was introduced into their work area: (Construction Reference: 1926.59)  At the residential construction site located at 5300 SW Mission Ave. in Topeka Kansas:  Employees engaged in roofing activities were exposed to chemical hazards in that employees had not been provided with training or information regarding the hazardous chemicals with which they work.  Hazardous chemicals such as gasoline were used at the residential construction site.
