OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to chemical incompatibility hazards from improper storage of chemicals.     On or about December 15, 2015:      Employees were exposed to a violent chemical reaction and explosion hazards from the improper storage of chemicals.  Incompatible chemicals such as muriatic acid and buckets with chlorine residue in them were stored next to one another, and where the muriatic acid was stored on the floor of the pool maintenance/chlorine room.          Among other methods, one feasible and acceptable method to correct this hazard is to segregate the chemicals by storing the muriatic acid in a corrosive storage cabinet.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   On or about December 15, 2015: Employees working in the pool area are required to wear a 3M half face respirator with combination cartridges when working with pool chemicals.  The employer had not developed, established, or implemented a written respiratory protection program.

29 CFR 1910.134(h)(2)(i): Respirators were not stored to protect them from damage, contamination, dust, sunlight, extreme temperatures, excessive moisture, and damaging chemicals or  were not packed or stored to prevent deformation of the facepiece and exhalation valve.   On or about December 15, 2015: Employees working in the pool area and required to use a 3M half face respirator are exposed to chemical contact and respiratory hazards where the 3M respirator was improperly stored in a crate next to chemical contaminated gloves.

29 CFR 1910.151(c): Where employees were exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use.   On or about December 15, 2015: Employees working in the chemical room and pool maintenance room are exposed to corrosive chemicals such as but not limited to hydrochloric acid (muriatic acid), calcium hypochlorite granular, and sodium hypochlorite.  There was not an emergency shower or eyewash in the area.
