29 CFR 1926.602(c)(1)(ii): Modifications or additions which affect the capacity or safe operation of the equipment were made without the manufacturer's written approval. If such modifications or changes are made, the capacity, operation, and maintenance instruction plates, tags, or decals shall be changed accordingly. On or about 15 December 2015 and at times prior thereto, employees were unloading materials from a towable trailer using a choker sling connected to a single point shackle which was attached to the carriage of a rough terrain forklift, exposing two assisting employees to the hazard of being struck by moving equipment.
