29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) On or about 12/16/15, at AVI Foodsystems, located on 1545 Mount Read Boulevard, in Rochester, New York, employees were working on surfaces 10 feet above a roof landing with unprotected sides, and were not provided with fall protection. NO ABATEMENT CERTIFICATION REQUIRED

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: (a) On or about 12/16/15, at AVI Foodsystems, located on 1545 Mount Read Boulevard, in Rochester, New York, a portable extension ladder in use was not positioned so that the side rails extended at least 3 feet above the access level. The ladder was not tied off at the top and the access point was 15 feet above the lower surface. NO ABATEMENT CERTIFICATION REQUIRED
