29 CFR 1910.134(c)(1): Where respirators were necessary to protect the health of the employee, or whenever required, the employer did not establish and implement a written respiratory protection program with worksite-specific procedures as required by 1910.134 (c)(1)(i-ix):    a) On or about December 21, 2015, at the above located workplace, employees working with Calcium Hypochlorite Chlorine and/or Sodium Dichloroiscyanurate Dihydrate were required to wear a full face negative pressure air purifying respirator.  The employer did not establish and implement a written respiratory protection program with worksite-specific procedures as required by 1910.134 (c)(1)(i-ix).

29 CFR 1910.134(e)(1):  The employer did not provide a medical evaluation to determine the employee's ability to use a respirator, before the employee was fit tested or required to use the respirator in the workplace:                       a) On or about December 21, 2015, at the above located workplace, employees working with Calcium Hypochlorite Chlorine and/or Sodium Dichloroiscyanurate Dihydrate were required to wear a full face negative pressure air purifying respirator. 29 CFR 1910.134(f)(1): The employer shall ensure that employees using a tight-fitting facepiece respirator pass an appropriate qualitative fit test (QLFT) or quantitative fit test (QNFT) as stated in this paragraph.    a) On or about March 26, 2014, at the above located workplace, employees were required to work with Calcium Hypochlorite Chlorine and/or Sodium Dichloroiscyanurate Dihydrate and were required to wear a tight-fitting, negative pressure, air purifying respirator. The employer did not ensure that each employee using a tight-fitting facepiece respirator passed an appropriate qualitative fit test or quantitative fit test.

29 CFR 1910.134(g)(1)(i)(A): Respirators with tight-fitting facepieces were worn by employees who had facial hair that came between the sealing surface of the facepiece and the face or that interfered with valve function:    a) On or about December 21, 2015, at the above located workplace, employees working with Calcium Hypochlorite Chlorine and/or Sodium Dichloroiscyanurate Dihydrate were allowed to wear facial hair that came between the seal surface of the face piece and the face.

29 CFR 1910.1200(e)(1): The employers did not develop, implement, and maintain a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training were to be met, and included a list of the chemicals known to be present in the workplace and the methods used to inform employees of the hazards of non-routine tasks and the hazards of chemicals contained in unlabeled pipes in the employee's work place:   a) On or about December 21, 2015, at the above located workplace, employees were required to work with Calcium Hypochlorite Chlorine, Sodium Dichloroiscyanurate Dihydrate and other hazardous chemicals. The employer did not establish and implement a written hazard communication program. Employees were thereby exposed to the hazards associated with chemical contact.

The employer did not train employees on hazards associated with the chemicals at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about was introduced into their work area.  Employees were thereby exposed to the hazards associated with the hazardous chemicals.

29 CFR 1904.29(b)(1): A Log of all recordable work-related injuries and illnesses (OSHA Form 300 or equivalent), was not completed in detail as required by the regulation:       a) On or about January 5, 2016, at the above located workplace, the employer's OSHA 300 form for 2015 was not completed in detail as required by 1904.4 through 1904.12. In that:     i) An employee working in the kitchen experienced cut a finger on 12/12/2015. The injury log for 2015 had the injury listed as a cut finger. There was no indication of the object that caused the injury.   ii) An employee in the engineering department experienced a "recordable", "Chlorine explosion" injury on 12/21/2015. The injury log for 2015 had the injury listed as a "Chlorine explosion" injury. There was no indication of the number of restricted days or the number of days away from work.    iii) ) An employee working in the kitchen cut a finger 12/30/2015. The injury log for 2015 had the injury listed as a "recordable" cut finger. There was no indication of the object that caused the injury or the  number of restricted days or the number of days away from work.
