On or about December 15, 2015, in the stores meat cooler and meat room, the employer failed to maintain the floors in clear and dry conditions which resulted in an employee slipping, then falling, striking his head and later dying from the resulting injuries. b. On or about December 21, 2015, in the stores meat cooler and meat room, the employer failed to maintain the floors in a clear and dry conditions which exposed two (2) employees to injuries resulting from slip and fall hazards.

29 CFR 1910.1030(f)(2)(i): Hepatitis B vaccination was not made available within 10 working days of initial assignment to all employee(s) with occupational exposure: a. Throughout the store: On or about December 21, 2015, four employees who were responsible for the clean-up of bloodborne pathogens and other potentially infectious materials (OPIM) had a reasonably anticipated occupational exposure to blood pathogens and OPIM and were not provided with the Hepatitis B vaccine. These employees were not offered Hepatitis B vaccinations within 10 days of assignment as first-aid providers.

29 CFR 1910.1200(h)(3)(iv): The details of the hazard communication program developed by the employer, did not include an explanation of the labels received on shipped containers and the workplace labeling system used by their employer; the safety data sheet, including the order of information and how employee could obtain and use the appropriate hazard information: a. On or about December 21, 2015, throughout work areas of the grocery store, employees used hazardous chemicals, such as, but not limited to, drain opener, oven grill and fryer cleaner, disinfectants, detergents, and block whitener, while cleaning their respective work areas and the employer did not explain the new labeling system and safety data sheet requirements under the new hazard communication program (GHS 2012).
