29 CFR 1910.136(a): General requirements. The employer shall ensure that each affected employee uses protective footwear when working in areas where there is a danger of foot injuries due to falling or rolling objects, or objects piercing the sole, or when the use of protective footwear will protect the affected employee from an electrical hazard, such as a static-discharge or electric-shock hazard, that remains after the employer takes other necessary protective measures:    On or about December 21, 2015, in the facility, warehouse employees, including, but not limited to, those employees required to work in the Doosan Heavy department, were exposed to potential foot injuries when handling heavy truck parts that may weigh up to 60 lbs or more.  The employer did not ensure that each affected employee used protective footwear to protect against foot injuries from falling or rolling parts.

29 CFR 1910.132(d)(2): The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.  On or about December 21, 2015, in the facility, warehouse employees, including, but not limited to, employees required to work in the Doosan Heavy department, were exposed to potential foot injuries when handling heavy truck parts that may weigh up to 60 lbs or more.  The employer did not verify, through a written certification, that the required workplace hazard assessment had been performed.

29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance shall be conducted at least once every three years:    On or about December 21, 2015, in the facility, warehouse employees were required to operate powered industrial trucks, including, sit-down forklifts, reach and order pickers.  An evaluation of each powered industrial truck operator's performance had not been conducted at least every three years.
