Employers and building and facility owners must exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM. a) The employer is failing to protect employees from respiratory hazards associated with Asbestos Containing Materials (ACM) and or Presumed Asbestos Containing Material (PACM). This was most recently documented on or about the 23 February, 2016, Evangel University failed to determine the presence, location and quantity of ACM and or PACM for all locations where employees may be exposed to ACM and or PACM.

This was most recently documented on or about the 23 February, 2016 when Kendrick Library housekeeping/custodial employees and Krause Hall Laundry Room housekeeping/custodial employees were not informed of the presence and location of ACM and PACM.

This most recently occurred on or about 23 February, 2016, in Kendrick Library and Krause Hall mechanical and laundry rooms when the employer failed to post signs at the entrances to these areas.

29 CFR 1910.1001(j)(5)(i): The employer did not ensure that labels were affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers. Owner or employer identified, previously installed, ACM and/or PACM, was not labeled or signs affixed or posted so that employees would be notified of what materials contained ACM and/or PACM. The employer failed to attach such labels in areas where they would be clearly noticed by employees who were likely to be exposed, such as at the entrance to mechanical room/areas.: a) Evangel University is failing to affix signs or labels to Asbestos Containing Materials (ACM) and or Presumed Asbestos Containing Material (PACM) such that it was clearly noticeable to employees. This most recently occurred on or about the 23 February, 2016, in Kendrick Library and Krause Hall where signs or labels were not clearly identifiable as noting asbestos.

29 CFR 1910.1001(k)(2): All spills and sudden releases of material containing asbestos were not cleaned up as soon as possible: a) Evangel University is not cleaning up as soon as possible, sudden releases of asbestos. This was most recently noted on or about 23 February, 2016, in the Kendrick Library books shelves area where loose and broken 9" X 9" ACM tiles were stacked and had been stacked after many years of floor damage. Damaged floor tile were not addressed at the time of the damage.
