29 CFR 1910.1001(j)(3)(i): Building and facility owners must determine the presence, location, and quantity of ACM and/or PACM at the work site. Employers and building and facility owners must exercise due diligence in complying with these requirements to inform employers and employees about the presence and location of ACM and PACM.  a) The employer is failing to protect employees from respiratory hazards associated with Asbestos Containing Materials (ACM) and or Presumed Asbestos Containing Material (PACM). This was most recently documented on or about the 23 February, 2016, Evangel University failed to determine the presence, location and quantity  of ACM and or PACM for all locations where employees may be exposed to ACM and or PACM.

29 CFR 1910.1001(j)(3)(iii): Building and facility owners must inform employers of employees, and employers must inform employees who will perform housekeeping activities in areas which contain ACM and/or PACM of the presence and location of ACM and/or PACM in such areas which may be contacted during such activities.  a) Evangel University failed to provide information to employees of the presence and location of the Asbestos Containing Materials (ACM) and or Presumed Asbestos Containing Material (PACM) in their areas. This was most recently documented on or about the 23 February, 2016 when Kendrick Library housekeeping/custodial employees and Krause Hall Laundry Room housekeeping/custodial employees were not informed of the presence and location of ACM and PACM.

29 CFR 1910.1001(j)(7)(iv): The employer failed to provide, at no cost to employees who perform housekeeping operations in an area which contained presumed asbestos-containing material (PACM) and/or other asbestos-containing material (ACM), an asbestos awareness training course:  a) Evangel University failed to provide asbestos awareness training to employees who performed housekeeping duties in areas containing Asbestos Containing Material (ACM). This occurred most recently on or about the 23 February, 2016, when custodial staff that performed housekeeping duties in areas containing ACM including Kendrick Library book shelves and Kendrick Library mechanical room.

29 CFR 1910.1001(j)(4)(iv): 29 CFR 1910.1001(j)(4)(iv):  At the entrance to mechanical rooms/areas in which employees reasonably can be expected to enter and which contain asbestos containing material (ACM) and/or presumed asbestos containing material (PACM), the building owner did not post signs which identify the material which is present, its location, and appropriate work practices which, if followed, will ensure that ACM and/or PACM will not be disturbed.  a) Evangel University failed to post signs at the entrances to areas that contained Asbestos Containing Material (ACM). This most recently occurred on or about 23 February, 2016, in Kendrick Library and Krause Hall mechanical and laundry rooms when the employer failed to post signs at the entrances to these areas.

29 CFR 1910.1001(j)(5)(i): The employer did not ensure that labels were affixed to all raw materials, mixtures, scrap, waste, debris, and other products containing asbestos fibers, or to their containers. Owner or employer identified, previously installed, ACM and/or PACM, was not labeled or signs affixed or posted so that employees would be notified of what materials contained ACM and/or PACM. The employer failed to attach such labels in areas where they would be clearly noticed by employees who were likely to be exposed, such as at the entrance to mechanical room/areas.:  a) Evangel University is failing to affix signs or labels to Asbestos Containing Materials (ACM) and or Presumed Asbestos Containing Material (PACM) such that it was clearly noticeable to employees. This most recently occurred on or about the 23 February, 2016, in Kendrick Library and Krause Hall where signs or labels were not clearly identifiable as noting asbestos.

29 CFR 1910.1001(k)(2): All spills and sudden releases of material containing asbestos were not cleaned up as soon as possible:  a) Evangel University is not cleaning up as soon as possible, sudden releases of asbestos. This was most recently noted on or about 23 February, 2016, in the Kendrick Library books shelves area where loose and broken 9" X 9" ACM tiles were stacked and had been stacked after many years of floor damage. Damaged floor tile were not addressed at the time of the damage.

29 CFR 1910.1001(k)(6): Waste, scrap, debris, bags, containers, equipment, and clothing contaminated with asbestos consigned for disposal, were not collected and disposed of in sealed impermeable bags, or other closed, impermeable containers:  a)  Evangel University is failing to collect into sealed impermeable bags or containers Asbestos Containing Material for the purpose of disposal. This most recently was noted on or about 23 February, 1016, in the Kendrick library where 9" X 9" ACM tiles were found in a stack where they had been placed over the years as they became loose and broken from the book shelves floor area.
