29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:   On or about January 15th, 2016, and times prior thereto, at this facility, the employer had not established or implemented a respiratory protection program when employees were required to wear tight-fitting respirators when cutting fiberglass sheets, putting the adhesive and resin on fiberglass layers, pouring foam on the bottom of the boats and/or when boat parts were sprayed with hazardous chemicals.  An effective respiratory protection program would include, but not limited to:  a.    Procedures for selecting respirators for use in the work place; b.    medical evaluation of employees required to wear respirators; c.    a valid fit testing procedures for each type of tight-fitting respirators; d.    procedures and schedules for cleaning, disinfecting, storing, inspecting, repairing, discarding and maintaining           respirators; and, e.    training of employees in the proper use of respirators.

29 CFR 1910.134(f)(2): Employee(s) using tight-fitting facepiece respirators were not fit tested whenever a different respirator facepiece (size, style, model or make) was used:  On or about January 28th, 2016, and times prior thereto, at this facility, employees were required to wear tight-fitting respirators when cutting fiberglass sheets, putting the adhesive and resin on fiberglass layers, pouring foam on the bottom of the boats and/or when boat parts were sprayed with hazardous chemicals.  The following respirators were worn:  a.    3M Reusable Half Face Respirator 7502 with 3M Organic Vapor Cartridge 6001; and,  b.    3M 8210 Particulate Respirator N95.

29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met:  On or about January 28th, 2016, and times prior thereto, at this facility, employees were cutting fiberglass sheets, putting the adhesive and resin on fiberglass layers, pouring foam on the bottom of the boats or when boat parts were sprayed with hazardous chemicals such as, but not limited to, SP10PUF1 Isocyanates, SPRITZ-20-1.7-SP10PUF1 Catalyst, POLYCOR 970C981, 905 TR Mold Prep Cleaner, Acetone, STYPOL LHPC-2700 Resin, H&C Shark Grip Slip Resistant Additive, 970X900 SPEED PATCHAID and/or different types of coatings, industrial paint finishes and peroxides.  The employer had not developed a program which would address labeling and other forms of warning on chemicals containers, Safety Data Sheets and employees information and training on the hazards associated with chemicals used at this site.  The written program must also contain the following:  1.    a list of all hazardous chemicals on site; 2.    the methods the employer will use to inform employees of the hazards associated with non-routine tasks involving         chemicals, such as a spill; 3.    the hazards of chemicals contained in piping that is not labeled; and, 4.    the method the employer will use to inform other employers (contractors) of the chemicals their employees might           be exposed to while performing duties at this site.
