29 CFR 1910.132(d)(1): The employer did not assess the workplace to determine if hazards are present, or are likely to be present, which necessitate the use of personal protective equipment (PPE): (a)Mark Juhl Auto Sports, Inc. @ 1700 N. Minnesota Ave., Sioux Falls, SD 57104: On and before December 28, 2015, the employer did not assess the workplace to determine if hazards were present, or likely to be present, which necessitate the use of PPE. An employee uses a caustic chemical to clean the rims of vehicles. This condition exposed an employee to health hazards associated with using caustic liquids to clean rims and not having the proper PPE to wear during the application. The employer has implemented work rules for the use of PPE, however a workplace assessment has not been performed and certified by the employer. Abatement note: The employer shall verify that the required workplace hazard assessment has been performed through a written certification that shall include the following: (1) Identifies the workplace evaluated; (2) The person certifying that the evaluation has been performed; (3) The date(s) that the hazard assessment was performed; and (4) Which identifies the document as a certification of hazard assessment.

29 CFR 1910.151(c): Where the eyes or body of any person may be exposed to injurious corrosive materials, suitable facilities for quick drenching or flushing of the eyes and body shall be provided within the work area for immediate emergency use. (a)Mark Juhl Auto Sports, Inc. @ 1700 N. Minnesota Ave., Sioux Falls, SD 57104: On and before December 28, 2015, the employer did not provide suitable facilities for quick drenching or flushing of the eyes and body were not provided within the work area for immediate emergency use. Corrosive chemicals including, but not limited to, Purple Stuff Degreaser, are used by employees. This condition exposes employees to a chemical burn hazard. Abatement Note: A feasible means of abatement includes but is not limited to: 1) a portable eye wash device, appropriate for the expected hazardous exposure, and containing not less than one gallon of potable water; or 2) a plumbed emergency eyewash unit capable of delivering not less than 1.5 liters (0.4 gallons) of clean water per minute, with flow valves that are simple to operate, go "on" in one second or less, and remain "on" during the eyewash procedure. For details on emergency eyewash and shower equipment, OSHA references the American National Standard for Emergency Eyewash and Shower Equipment, ANSI Z358.1.

Minnesota Ave., Sioux Falls, SD 57104:On and before December 28, 2015, the employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trained about is introduced into their work area such as but not limited to: (1)Stinger Purple Stuff Degreaser (2)Zymek Enzyme Cleaner 80-962 (3)Super Dress-It Abatement Note: (a) Employees shall be informed of: (1) Any operation in their work area where hazardous chemicals are present; and, (2) The location and availability of the written hazard communication program, including the required list(s) of hazardous chemicals, and safety data sheets required by this section. (b) Employee training shall include at least: (1) Methods and observations that may be used to detect the presence or release of a hazardous chemical in the work area (such as monitoring conducted by the employer, continuous monitoring devices, visual appearance or odor of hazardous chemicals when being released, etc.); (2) The physical and health hazards of the chemicals in the work area; (3) The measures employees can take to protect themselves from these hazards, including specific procedures the employer has implemented to protect employees from exposure to hazardous chemicals, such as appropriate work practices, emergency procedures, and personal protective equipment to be used; (4) The details of the hazardous communication program developed by the employer, including an explanation of the labeling system and the material safety data sheet, and how employees can obtain and use the appropriate hazard information.
