29 CFR 1910.1200(e)(1): The employer did not develop, implement, and/or maintain at the workplace a written hazard communication program which describes how the criteria specified in 29 CFR 1910.1200(f), (g), and (h) will be met: (a) Managed Labor Solutions, LLC., at 23520 E. 78th Ave, Denver, CO: On and before December 16, 2015 the employer did not ensure that a written hazard communication program was developed and implemented for the establishment. This condition exposed employees to chemical hazards associated with the use of chemicals such as but not limited to: 1. ChemStation of the Rockies automotive cleaning soap product 4422 which contains 2-butoxyethanol and potassium hydroxide. Possible hazards associated with use of this product include eye and skin irritation. 2. Splash Windshield Washer Fluid which contains methanol. Possible hazards associated with use of this product include eye, skin, and upper respiratory system irritation.

29 CFR 1910.1200(f)(5)(i): The employer did not ensure that each of the hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the chemical contained therein: (a) Managed Labor Solutions, LLC at 22385 East 78th Avenue, Denver, CO: On and before December 16th, 2015, the employer did not ensure that each container of hazardous chemicals in the workplace was labeled, tagged or marked with the identity of the chemical contained therein. Employees used power washing equipment used to clean the exterior of cars. The power washing equipment pulled soap from plastic drums kept on the sides of the wash bays. The containers used to store this chemical did not have labeling that would identify the contents of the containers. This condition exposed employees to health and physical hazards.

29 CFR 1910.1200(h)(1): Employers shall provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability, carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and safety data sheets.
