29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toe boards (Toe boards are only required when persons can pass, there is moving equipment or there is equipment with which falling materials could create a hazard):    On or about December 30, 2015, the employer failed to provide standard railings and toe boards for the ground level working area that Is located in the main working area, next to the employee break room, to protect employees, equipment and materials from falling down to the adjacent ground level of the paint pit which is a distance of approximately 14 feet down.  Directly at that base of the paint pit are metal materials and beams.

On or about December 30, 2015, the employer failed to ensure the emergency exit had lighting so as to aid in the even of an emergency evacuation.  The exit door located in the middle of the main facility, past the welding operation area behind support beam #223.

29 CFR 1910.134(c)(1): A written respiratory protection program that included the provisions in 29 CFR 1910.134(c)(1)(i) - (ix) with worksite specific procedures was not established and implemented for required respirator use:      On or about December 30, 2015, the employer failed to develop and implement a Respiratory Protection Program for protection of employees who are working with chemicals such as but not limited to:  Welding Wire, Black Primer and Xylene.  Employees are wearing half mask respirators with Organic Vapor Cartridges (NIOSH 100100) without being medically evaluated or fit tested.

29 CFR 1910.243(c)(1): Abrasive wheel(s) were used on portable grinder(s) which were not provided with safety guard(s) meeting the requirements specified in 29 CFR 1910.243(c)(1) through (c)(4)(a):    On or about December 30, 2015, the employer did not ensure effective that employees maintained in a safe condition tools that were being used to cut off end pieces of material being welded in the welding bay area.

29 CFR 1910.303(g)(2)(i): Except as elsewhere required or permitted by Subpart S of Part 1910, live parts of electric equipment operating  at 50 volts or more were not guarded against accidental contact by use of approved cabinets or other forms of approved enclosures or by any of the means identified in paragraphs (A), (B), (C), and (D) of 29 CFR 1910.303(g)(2)(i):    On or about December 30, 2015, the employer failed to ensure the electrical box at the arc welding station, which was located across the way from support beam #226, was closed.  The 240 volt electrical box has an arc welding assembly hard wired into the box, which did not allow for the box to be closed.  There are broken windows up above the support beam which has the electrical panel box on it and when it rains hard, water leaks down and into the box.
