29 CFR 1926.501(b)(10): "Roofing work on Low-slope roofs." Except as otherwise provided in paragraph (b) of this section, each employee engaged in roofing activities on low-slope roofs, with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems, safety net systems, personal fall arrest systems, or a combination of warning line system and guardrail system, warning line system and safety net system, or warning line system and personal fall arrest system, or warning line system and safety monitoring system. Or, on roofs 50-feet (15.25 m) or less in width (see Appendix A to subpart M of this part), the use of a safety monitoring system alone [i.e. without the warning line system] is permitted.    (a)  Porch area - On or about December 31, 2015 employees were exposed to a fall hazard while working on a flat roof 28 feet above concrete with no fall protection.

Each employee on a steep roof with unprotected sides and edges 6 feet (1.8 m) or more above lower levels shall be protected from falling by guardrail systems with toeboards, safety net systems, or personal fall arrest systems.  (a)  Main Roof of Priority One Bank - On or about December 31, 2015 employees were exposed to a fall hazard while working on a steep roof 35 feet the ground with no fall protection. The pitch of the roof was 7/12.

29 CFR 1926.502(h)(1)(iii): The safety monitor shall be on the same walking/working surface and within visual sighting distance of the employee being monitored    (a)  Porch area - On or about December 31, 2015 employees were exposed to a fall hazard while working on a flat roof due to the safety monitor not being on the same level and not actively observing all employees involved in work on the roof.

29 CFR 1910.1200(e)(1): Employers shall develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, material safety data sheets, and employee information and training will be met, and which also includes the following:  (a)  Priority One Bank (construction site) - On or about December 31, 2015 the employer did not maintain a Hazardous Communication Program.  Employees were exposed to potential serious injury while using a Flammable Liquid known as Firestone Ultra-Ply Bonding Adhesive without the availability of a Safety Data Sheet (SDS) in the work area.
