29 CFR 1926.502(b)(1): The top edge height of the top rails, or equivalent guardrail system members, was not 42 inches (1.1 m) plus or minus 3 inches (8 cm) above the walking/working level:    a)  9th floor - On or about January 4, 2016 and at times prior thereto, the top rail height of the guardrail on the Southern half of the East side of the building was only 30" from the walking/working level exposing employees to a fall hazard of 2 stories to the 7th floor with the potential to fall to the netting system set up at the 5th floor.    b) 8th floor - On or about January 4, 2016 and at times prior thereto, the top rail height of the South facing guardrail on the East side of the building was only 34" from the walking/working level exposing employees to a fall hazard of 1 story to the 7th floor with the potential to fall to the netting system set up at the 5th floor.
