29 CFR 1926.1101(k)(1)(ii): The employer did not include asbestos in the program established to comply with the Hazard Communication Standard (HCS) 29 CFR 1910.1200, did not ensure that each employee had access to labels on containers of asbestos and safety data sheets, did not ensure hazard communication training on asbestos in accordance with the provisions of the Hazard Communication Standard 29 CFR 1910.1200 as well as paragraphs (k)(9) and (10) of this section: a) 106 N. Grove St., East Orange, NJ The employer did not include asbestos in the hazard communication program and ensure that each employee had access to labels, safety data sheets, and training in the hazards of asbestos. Employees performing electrical work were exposed to thermal systems insulation (TSI) containing up to 40% Chrysotile asbestos, floor tile containing up to 13% Chrysotile asbestos and wall plaster containing 2% Chrysotile asbestos. Condition observed on or about 12/11/2015.

29 CFR 1926.1101(k)(3)(i): Before the employer permitted its own employees to perform work subject to this standard in areas containing asbestos-containing material (ACM) and presumed asbestos-containing material (PACM), the employer did not identify the presence, location and quantity of asbestos containing material and/or presumed asbestos containing material therein pursuant to 29 CFR 1926.1101(k)(1): a) 106 N.Grove St., East Orange, NJ The employer did not identify the presence, location and quantity of asbestos for employees installing new electrical service during the renovation of a 82 unit apartment building. Employees were exposed to thermal systems insulation containing up to 40% Chrysotile asbestos, floor tile containing up to 13% Chrysotile asbestos and wall plaster containing 2% Chrysotile asbestos. Condition observed on or about 12/11/2015.

29 CFR 1926.1101(k)(3)(ii): Before work under this standard was performed, the employer did not inform employees of the location and quantity of ACM and/or PACM present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area: a) 106 N.Grove St., East Orange, NJ The employer failed to notify employees of the presence of asbestos in the thermal system insulation (TSI) located on the boilers in the basement and failed to inform them of precautions to take to minimize airborne release of asbestos while installing new electrical service and storing materials in this area. The TSI contained up to 40% Chrysotile asbestos. Condition observed on or about 12/11/2015.
