The employer shall use either ground fault circuit interrupters as specified in paragraph (b)(1)(ii) of this section or an assured equipment grounding conductor program as specified in paragraph (b)(1)(iii) of this section to protect employees on construction sites. These requirements are in addition to any other requirements for equipment grounding conductors. Location: 1329-1333 Myrtle Ave., Brooklyn, NY. a) Employees utilized a Hilti Hammer Drill that was powered by an extension cord that was not provided with a GFCI or an assured equipment program; on or about 12/30/15.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. Location: 321 W. 35th St., New York, NY. a) Employer did not install a guardrail at the perimeter of the pathway at the entrance of the site. Employees were exposed to a potential fall hazard of up to 10 ft. to the floor below; on or about 12/30/13.
