29 CFR 1926.1053(b)(4): Ladders were used for purposes other than the purposes for which they were designed: (a)John Morrell & Company@ 1400 N. Weber Avenue, Sioux Falls, SD 57103: On or about December 12, 2015, the employer did not ensure employees were using astepladder for the purposes for which they were designed. Employees were utilizing a 12 foot Werner stepladder, model # 6212, leaned against the wall to gain access to the ceiling to remove existing sewer lines and install new lines. The manufacturer specifically indicates that it is unsafe to climb a stepladder that is closed. This condition exposed employees to a fall hazard of approximately 9 feet.

29 CFR 1926.1101(f)(2)(i): Each employer who has a workplace or work operation covered by this standard shall ensure that a "competent person" conducts an exposure assessment immediately before or at the initiation of the operation to ascertain expected exposures during that operation or workplace. The assessment must be completed in time to comply with requirements which are triggered by exposure data or the lack of a "negative exposure assessment," and to provide information necessary to assure that all control systems planned are appropriate for that operation and will work properly. Weber Avenue, Sioux Falls, SD 57103: On or about December 12, 2015, the employer did not ensure that a competent person conducted an exposure assessment prior to the asbestos-team removing potentially asbestos containing ceiling tiles.

Employees worked in an area where near-by pipes that were wrapped in damaged asbestos-containing material could have liberated asbestos fibers.

29 CFR 1926.1101(k)(9)(vi): Training for employees performing Class IV operations shall be consistent with EPA requirements for training of local education agency maintenance and custodial staff as set forth at 40 CFR 763.92(a)(1). Such a course shall include available information concerning the locations of thermal system insulation and surfacing ACM/PACM, and asbestos-containing flooring material, or flooring material where the absence of asbestos has not yet been certified; and instruction in recognition of damage, deterioration, and delamination of asbestos containing building materials. Such course shall take at least 2 hours. (a)John Morrell & Company@ 1400 N. Weber Avenue, Sioux Falls, SD 57103: On or about December 12, 2015, the employer did not provide appropriate training to maintenance staff performing work in areas where asbestos may be present.
