Esser Builders, LLC worksite located at 12317 Roosevelt Blvd., Perrysburg, Ohio: On or about December 22, 2015, the employer failed to ensure an accident prevention program was in place to aid the employer and his employees in the recognition and avoidance of hazards associated with residential roofing operations (i.e.; fall protection and the proper use of ladders).

29 CRF 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe conditions and the regulations applicable to his work environment to control or eliminate any hazards or other exposure to illness or injury.   A. Esser Builders, LLC worksite located at 12317 Roosevelt Blvd., Perrysburg, Ohio: On or about December 22, 2015, the employer failed to instruct all employees in the recognition and avoidance of hazards commonly seen in the roofing industry. An employee was seriously injured after falling from a ladder while performing roofing work. Employees were not effectively trained to recognize effective and ineffective means of fall protection and ladder use.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8 m) or more above lower levels was not protected by guardrail systems, safety net system, or personal fall arrest system unless another provision in paragraph (b) of this section provides for an alternative fall protection measure.    A. Esser Builders, LLC worksite located at 12317 Roosevelt Blvd., Perrysburg, Ohio: On or about December 22, 2015, the employer did not ensure employees were protected from falls while performing roofing work above the porch of a two story residential structure. The employees were exposed to a potential fall distance of approximately 10.00 feet.

29 CFR 1926.1053(b)(6): Ladders shall be used only on stable and level surfaces unless secured to prevent accidental displacement.   A. Esser Builders, LLC worksite located at 12317 Roosevelt Blvd., Perrysburg, Ohio: On or about December 22, 2015, the employer failed to ensure the extension ladder used to access the upper roof was stable and secured. An employee was using the ladder, which was not secured, became displaced resulting in the employee falling and sustaining serious injuries.

A. Esser Builders, LLC worksite located at 12317 Roosevelt Blvd., Perrysburg, Ohio: On or about December 22, 2015, the employer failed to report a serious injury resulting in an in-patient hospitalization of the employee. The employee sustained serious head injuries after falling at a residential construction site.
