29 CFR 1910.1048(h)(1)(i): All contact of the eyes and skin with liquids containing 1 percent or more formaldehyde was not prevented by the use of chemical protective clothing made of material impervious to formaldehyde and the use of other personal protective equipment such as goggles and face shields, as appropriate to the operation: On or about January 11th 2016, at the jobsite located at the 16505 NW 27th Ave. Miami Gardens, FL 33054, the employer did not ensure that the employee exposed to corrosive chemical such as, Champion PK, Introfiant and Power 36, containing at least 14% by weight of formaldehyde during the embalming process would wear adequate face protection such as a face shield to avoid a splash hazard.

29 CFR 1910.1048(m)(1)(iii): The employers did not include formaldehyde in the hazard communication program established to comply with the HCS (� 1910.1200). Employers did not ensure that each employee had access to labels on containers of formaldehyde and to safety data sheets, and was trained in accordance with the requirements of HCS and paragraph (n) of this section. On or about January 11th 2016, at the jobsite located at the 16505 NW 27th Ave. Miami Gardens, FL 33054, the employer did not develop an effective hazard communication program for employees who were exposed to hazardous chemicals such as Champion PK, Introfiant and Power 36, containing formaldehyde and used during the embalming process.

Note: If the employer can show, using objective data, that employees were not exposed to formaldehyde at or above 0.1 ppm, the employer is not required to provide training. On or about January 11th 2016, at the jobsite located at 16505 NW 27th Ave. Miami Gardens, FL 33054, the employer did not provide training about formaldehyde to employees at the job place, while the employees are exposed to 0.33 ppm of formaldehyde during 15 minutes sampling period.
