29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems:  a)  At the jobsite, on the 4th floor deck, on or about 1/5/16:  Employees were working in close proximity to the edge of a working surface, approximately 30 feet from ground without fall protection.  b)  At the jobsite, on the 4th floor deck, on or about 1/5/16:  Employees were working in close proximity to the edge of a working surface and an unprotected elevator shaft approximately 30 feet from the lower level, without fall protection.

29 CFR 1926.501(b)(4)(i): Each employee on walking/working surfaces was not protected from falling through holes (including skylights) more than 6 feet (1.8 m) above lower levels, by personal fall arrest systems, covers, or guardrail systems erected around the openings:  a)  At the jobsite, on the 4th floor deck, on or about 1/5/16:  Employees were directly over a hole where the cover had been unsecured and the marking had worn off.    b)  At the jobsite, on the 4th floor deck, on or about 1/5/16:  Employees were working in close proximity to an unprotected hole that was adjacent to an unprotected elevator shaft.

29 CFR 1926.451(g)(4)(ii): The top edge height of top-rails on supported scaffolds exceed the maximum height of 45 inches for scaffolds manufactured and put into service before January 1, 2000 and also for scaffolds manufactured and put into service after January 1, 2000.   a)  At the Northwest side of the building, on the 4th floor deck, on or about 1/5/16:  Employees were working on a supported scaffold where the working level was approximately 8 feet from the deck and approximately 38 feet from ground at the outside edge.  The top-rail of this scaffold was placed approximately 60 inches from the working level.  Abatement certification must be submitted for this item.

29 CFR 1926.502(d)(6)(v): A snap-hook was connected to an object which is incompatibly shaped or dimensioned in relation to the snaphook such that unintentional disengagement could occur by the connected object being able to depress the snaphook keeper and release itself.  a)  At the Northwest side of the building, on the 4th floor deck, on or about 1/5/16:  Employees were working on a supported scaffold where the working level was approximately 8 feet from the deck and approximately 38 feet from ground at the outside edge.  Workers were wearing personal fall arrest equipment where the anchor that they were attached to was of a type and configuration that was not compatible with the snap-hook.     b)  At the Southwest side of the building, on the 4th floor deck, on or about 1/5/16:  Employees were working on a supported scaffold where the working level was approximately 8 feet from the deck and approximately 38 feet from ground at the outside edge.  Workers were wearing personal fall arrest equipment where the anchor that they were attached to was of a type and configuration that was not compatible with the snap-hook.     Abatement certification must be submitted for this item.

29 CFR 1926.1053(b)(13), referencing 29 CFR1926.451(e): The top or top step of a stepladder was used as a step:  a)  At the Southwest side of the building, on the 4th floor deck, on or about 1/5/16:  An employee climbed a 6 foot step ladder to access the scaffold plank that was also 6 feet from the deck and where the employee stepped onto the top two levels of the ladder.
