29 CFR 1910.1200(e)(1): The employer did not develop, implement, and maintain at each workplace, a written hazard communication program which at least describes how the criteria specified in paragraphs (f), (g), and (h) of this section for labels and other forms of warning, safety data sheets, and employee information and training will be met. On or about January 12, 2015 the employer had not developed a written hazard communication program where an employee assigned to perform welding activities was exposed to hazards associated with the use of chemicals including, but not limited to, compressed argon gas, compressed acetylene gas, compressed oxygen, "Radnor" E6011 carbon steel electrodes, and fumes from steel and aluminum welding.

29 CFR 1910.1200(g)(1): The employer did not have a safety data sheet in the workplace for each hazardous chemical which they use. On or about January 12, 2015 the employer had not safety data sheets for chemicals known to be present in the workplace where an employee assigned to perform welding activities was exposed to hazards associated with the use of compressed argon gas, compressed acetylene gas, compressed oxygen, "Radnor" E6011 carbon steel electrodes, and fumes from steel and aluminum welding.

29 CFR 1910.1200(h)(1): The employer did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new chemical hazard the employees have not previously been trained about is introduced into their work area. On or about January 12, 2015 the employer had not provided hazard communication training to an employee assigned to perform welding activities involving chemicals including, but not limited to, compressed argon gas, compressed acetylene gas, compressed oxygen, "Radnor" E6011 carbon steel electrodes, and fumes from steel and aluminum welding.
