OSH ACT of 1970 Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck-by hazards: (a) Merchandise Receiving Process, Stock Room, On or about, January 11, 2016, and at times prior thereto, employees were exposed to struck-by hazards while receiving plastic totes containing store merchandise from a tractor trailer using a roller belt conveyor that was not maintained in good working order. (b) Merchandise Receiving Process, Stock Room, On or about, January 11, 2016, and at times prior thereto, employees were exposed to struck-by hazards while receiving plastic totes containing store merchandise from a tractor trailer using a roller belt conveyor that was unstable due to being supported on empty plastic totes.

29 CFR 1910.176(b): Storage of material created a hazard: Stock Room Entry Doorway: On or about January 11, 2015, employees were exposed to struck by hazards, when an unsecured 10 ft. A-Frame potable ladder was stored in a vertical position I foot from walkthrough, while entering the stockroom.
