29 CFR 1910.1030(c)(1)(v): The employer, who is required to establish an Exposure Control Plan, solicited input from non-managerial employees responsible for direct patient care who are potentially exposed to injuries from contaminated sharps in the identification, evaluation and selection of effective engineering and work practice controls and did not document the solicitation in the Exposure Control plan:  a.  On or about January 12, 2016, the employer solicited input from non-managerial  employees responsible for direct resident care such as, but not limited to, Licensed Practical Nurses (LPNs) and Med Care Managers, in the identification, evaluation of effective engineering and work practices controls that would potentially minimize the number of injuries from exposures to contaminated sharps and the employer did not document the solicitation in the Exposure Control Plan.

29 CFR 1910.1030(c)(2)(i)(C): The exposure determination did not include a list of all tasks and procedures or groups of closely related tasks and procedures in which occupational exposure occurs and that are performed by employees in job classifications listed in accordance with 29 CFR 1910.1030(c)(2)(i)(B):     a.  On or about January 12, 2016, the exposure determination of the company's Exposure Control Plan did not contain a list of all tasks and procedures or groups of closely related tasks and procedures for those job classifications where employees may incur an occupational exposure to bloodborne pathogens such as, but not limited to, Registered Nurse, Licensed Nurse, Care Manager, Housekeeper, Laundry, and Maintenance.  The tasks being performed include, but not limited to, taking care of residents, drawing blood, starting IVs, handling contaminated personal protective equipment and/or laundry, transporting and disposing contaminated waste, and cleaning surfaces contaminated with blood or other potentially infectious materials.

On or about January 12, 2016, at the resident room #218, the employer did not ensure that a container for contaminated sharps was easily accessible or located as close as feasible to the immediate area where sharps were used while the resident administered her own medical injection. Therefore an employee or the resident would have to travel to a remote location to discard a sharp.      b.  On or about January 12, 2016, at the laundry room, the employer did not ensure that a container for contaminated sharps was easily accessible or located as close as feasible to the laundry area where sharps could be reasonably anticipated to be found.
