29 CFR 1910.212(a)(1): One or more methods of machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks: On or about January 12, 2016, in the Pre-Sort Department, the conveyor belts at the two grading stations were not guarded. The employees were exposed to in-running nip points where the conveyor belt meets the metal plate.

29 CFR 1910.212(a)(3)(iii): Special hand tools for placing and removing material(s) was not provided to permit easy handling of material without the operator placing a hand in the danger zone: On or about January 12, 2016, in the Pre-Sort Department, employees remove bad fruit and leaves off the metal plate immediately in front of the conveyor belt and the table of white plastic rollers. The employees remove the fruit manually using their nitrile-gloved hands.

29 CFR 1910.1200(h)(1): Employers did not provide employees with effective information and training on hazardous chemicals in their work area at the time of their initial assignment, and whenever a new physical or health hazard the employees had not previously been trained about was introduced into their work area and chemical-specific information was not always available through labels and material safety data sheets: In the Pre-Sort Department, employees remove rotten fruit, leaves and stems from the wet fruit coming down the conveyor. The employees are not informed of the specific chemicals, such as, but not limited to, Clorox, they could potentially be exposed.
