29 CFR 1926.501(b)(10): Each employee engaged in roofing activities on low-slope roofs with unprotected sides and edges 6 feet or more above lower levels and 50-feet (15.25 m) wide or less, was not protected from falling by guardrail systems, safety net system, personal fall arrest system or a safety monitor: A) East 40th St., on or about January 13, 2016, employees were removing shingles from a 4 and 12 sloped roof without the use of fall protection equipment or a monitor, exposing the employees to a fall hazard of 18 feet.

29 CFR 1926.1053(b)(1): Where portable ladders were used for access to an upper landing surface and the ladder's length allows, the ladder side rails did not extend at least 3 feet (.9 m) above the upper landing surface being accessed: A) East 40th St., on or about January 13, 2016, the extension ladder used by the employees to gain access to the roof did not extend three feet above the roof edge, exposing employees to a fall hazard of approximately 18 feet.
