OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by/explosion hazards when operating a vacuum truck: (a) At the Peroxychem, LLC facility, on or about January 16, 2016, Evergreen Environmental Services did not evaluate the process the vacuum truck driver was dispatched to perform in that they did not ensure they understood the process, the chemicals involved or the hazards associated with the operation.

29 CFR 1910.119(h)(3)(i): The contract employer shall assure that each contract employee is trained in the work practices necessary to safely perform his/her job. On January 16, 2016 and at times prior thereto, at the Peroxychem facility in Pasadena, TX, the contract employer did not assure that each of its employees were trained in the work practices necessary to safely vacuum hydrogen peroxide and work solution (WS) mixture from T-4031 and then transfer the mixture to one of the SM tanks.
